Welcome to https://kamilafj.com (hereinafter: “the Site”), an online jewellery store operated by or on behalf of Mila Klar (hereinafter: “the Operator”). The Site enables you to view and purchase a range of jewellery items quickly, reliably and courteously. If you have any complaint, query or suggestion for improvement, please contact us via the “Contact Us” link; we will respond as swiftly and professionally as possible.

A. Definitions

  • “Content / Information” – any textual, visual or audio‑visual material offered on the Site (articles, catalogues, specifications, prices, photographs, illustrations, videos, animations, logos, icons, etc.) on any device.
  • “User / Customer / Visitor” – any individual or entity entering the Site, thereby expressing agreement to these Terms, whether or not a purchase is made.
  • “Product” – any item of jewellery offered for on‑line purchase on the Site for personal use.
  • “Order” – a purchase request placed by a User which has not yet been approved by the credit‑card company / payment processor or paid in full by any other method.
  • “Transaction” – a purchase that has been approved by the credit‑card company / payment processor or for which full payment has otherwise been completed.
  • “External Manufacturers / Suppliers” – third‑party producers whose products may be combined with the Operator’s products but are not themselves manufactured by the Operator.

B. General

  1. Use of the Site is subject to your full acceptance of these Terms, which constitute a binding legal agreement between you and the Operator with respect to the Site and its Content. These Terms replace any prior agreement between the parties.
  2. Terms are drafted in the masculine solely for convenience and apply equally to all genders.
  3. Section headings are for convenience only and shall not affect interpretation.
  4. By using the Site, you confirm that you are over 18 years of age, that you have read, understood and agree to be bound by these Terms, and that you waive any claim against the Operator arising from such use.
  5. If any provision hereof is unacceptable to you, please exit the Site and refrain from further use.
  6. The Operator reserves the exclusive right to update these Terms at any time without prior notice. Previous versions (if any) will be retained on the Site. It is the User’s responsibility to review updates; continued use constitutes acceptance of the revised Terms.
  7. The Operator may, at its sole discretion, modify Site Content, design, pricing, promotions, and even suspend or terminate operation of the Site without prior notice. No claim shall arise from such actions.
  8. All Content is provided “as is”. The Operator gives no warranty regarding availability, accuracy or reliability of the Site or the information therein. Images are illustrative and may not fully represent the actual Product.
  9. The Operator endeavours to display accurate information; however, images cannot guarantee exact colours or appearance. For clarifications, please contact customer service on +972 50‑933‑4428 before ordering.
  10. Before ordering, Users are solely responsible for verifying that Products meet their needs and for their correct use.
  11. The Operator is not liable for colour deviations, inaccuracies or errors in images, data or specifications.
  12. The Operator may suspend or block any User’s access to the Site at its sole discretion, including for breach of these Terms or of any law.

C. Use of the Site and User Obligations

  1. You may use the Site Content indefinitely in accordance with these Terms. Any other use requires prior written consent of the Operator.
  2. Content, images, designs and specifications are for your private, personal use only. You may not harvest information, copy, distribute, display or exploit it in any way that may harm the Operator’s business.
  3. You undertake not to distribute, transmit, sell, create derivative works from, or otherwise infringe any third‑party rights in connection with the Site.
  4. Registration is optional but required for certain actions, including placing orders. You will be asked to provide accurate personal details (full name, ID number, address, phone, email, etc.).
  5. Your login credentials are personal and non‑transferable. You must keep them confidential and notify the Operator immediately at milushq@gmail.com of any suspected breach.
  6. After registration you will receive login credentials enabling additional functions. You must keep them confidential and not transfer them to others.
  7. Via your profile you may contact the Operator and upload content/files. You warrant that you own all intellectual‑property rights in any material you upload and that such material does not infringe any third‑party rights.
  8. Providing false or misleading details or impersonating another is a criminal offence under Israeli law. The Operator may report offenders and seek damages.
  9. Acceptance of your registration and eligibility to place orders is at the Operator’s sole discretion.
  10. You undertake not to upload or transmit to the Site any unlawful, defamatory, obscene, harassing, racist, infringing or otherwise objectionable content.

D. Limitation of Liability

  1. The Operator shall not be liable, in contract or tort, for any direct, indirect, incidental, consequential or punitive damage, loss or expense arising from use of the Site or reliance on its Content.
  2. The Operator provides a 12‑month warranty for:
    a) small‑stone settings;
    b) manufacturing defects found after inspection.
  3. The Operator is not liable for plating, chains, clasps or other components not produced by it. Repairs may be offered at additional cost.
  4. With regard to Products made by External Manufacturers, the Operator’s liability is limited solely to refund of the purchase price paid (less statutory cancellation fees). Any claims relating to such Products will be forwarded to the relevant manufacturer.
  5. Hyper‑links to external sites are provided for convenience only. The Operator is not responsible for their availability, legality or content, and assumes no liability for damages arising from their use.
  6. The Operator is not liable for viruses, hacking, data breaches or other malicious activity affecting Users’ equipment or data.
  7. Likewise, the Operator is not liable for hostile intrusions into its databases or any resulting exposure of User information.

E. Online Orders

  1. Products may be purchased on‑line via the payment processor chosen by the Operator. Prices may be changed at any time without notice.
  2. Product information displayed on the Site constitutes sufficient publication. For additional details, contact the Operator.
  3. Payment shall include delivery costs and, where relevant, a gemmological certificate for items priced above ₪ 3,500. If an ordered item is out of stock the Operator may cancel or amend the order and refund the customer accordingly.
  4. Failure to pay the full amount may result in cancellation or suspension of the order.
  5. In case of a pricing error, the Operator will notify the User; the User may confirm the corrected price or cancel the order and receive a refund.
  6. Payment is normally by credit card, but the Operator may accept other methods at its discretion.
  7. A confirmation email acknowledges receipt of the order but is not final approval. Transaction approval is contingent on authorisation by the credit‑card company.
  8. If payment is not regularised within seven (7) business days after a denial, the Operator may cancel the order.
  9. Delivery times are calculated only from the date of transaction approval.
  10. The place of performance is deemed to be the Operator’s place of business, even if the customer chooses self‑collection.
  11. The Operator may decline any order for fraud‑prevention or other reasons, refunding any sums paid.

F. Cancellation of Transactions

  1. Cancellations are governed by the Israeli Consumer Protection Law, 1981 and its regulations. The effective cancellation date is when written notice (“Order Cancellation Form”) is received by the Operator.

G. Jewellery Return Policy

  • Items may be returned within 14 days of receipt in their original packaging, unused and undamaged, by mail together with written cancellation notice.
  • Items collected in person may be returned within 48 hours (excluding rest days) to the Operator’s address at 8 Ha‑Yarkon St., Ramat Gan.
  • Custom orders (special designs, non‑standard sizes, personal engravings, stones chosen specifically for the customer, etc.) are non‑returnable.
  • Upon return and inspection, the Operator may deduct the lower of 5 % of the item price or ₪ 100, plus shipping, payment‑gateway and credit‑card fees.
  • Diamond / gemstone items will be inspected; refund is subject to verification that the returned item is identical to that supplied.
  • For jewellery priced above ₪ 3,000 or personalised pieces, refunds or exchanges are at the Operator’s discretion.

H. Product Delivery

  1. Products will be delivered within 14 business days (or as otherwise agreed) to the address in Israel specified in the order, subject to full payment and stock availability.
  2. Deliveries are performed by third‑party couriers (e.g., Israel Post). The Operator is not liable for delays caused by force majeure or events beyond its control (strikes, war, natural disasters, etc.).
  3. Refusal or unreasonable failure to accept delivery constitutes completion of delivery; no claim shall be made in such cases.
  4. For remote or restricted areas the Operator may arrange delivery to an alternative agreed location.
  5. Delivery may, at the Operator’s discretion, be left at the locality’s post office, community office or similar facility, with notice to the customer.
  6. Courier deliveries are subject to the courier’s terms and conditions.
  7. Shipping fees shown on the Site exclude exceptional deliveries requiring extra manpower or equipment (e.g., no elevator).
  8. For self‑collection, the Operator may require presentation of the credit‑card holder and ID.
  9. Where Products are ordered as gifts or donations, the Operator is not liable if the recipient refuses delivery.
  10. Ownership passes to the User only upon actual delivery and full payment. Inspect the package on receipt; if damaged, refuse it and notify the Operator for replacement.

I. Intellectual Property

  1. All intellectual‑property rights in the Site, its domain name, software, graphics, design, layout, content, products, illustrations, videos, etc., are owned by the Operator or its business partners and are protected by Israeli and international law.
  2. No material from the Site may be copied, reproduced, distributed, displayed, translated, broadcast, licensed, sold or otherwise exploited without the prior written consent of the Operator.
  3. Users who upload content via their profile warrant full ownership and grant the Operator permission to use such content. Users shall indemnify the Operator against any infringement claim arising therefrom.

J. Indemnity

  1. You agree to indemnify and hold harmless the Operator, its agents and third parties from any loss, expense or damage (including attorney’s fees) resulting from your breach of these Terms.
  2. Indemnification shall be made within 14 business days of the Operator’s written demand, irrespective of legal proceedings or their outcome.

K. Mailings

  1. In accordance with Section 40 of the Israeli Telecommunications Law (Bezeq), 1982, you consent to receive marketing emails until you unsubscribe via the designated link. Unsubscribing will be effected promptly.

L. Jurisdiction

  1. These Terms shall be governed by the laws of the State of Israel. Exclusive jurisdiction lies with the competent courts in the Central District.
  2. If any provision is held invalid, the remaining provisions shall remain in full force and effect.

M. Miscellaneous

  1. The Operator may assign its rights and obligations hereunder to any third party without notice.
